This Regulation deals with the health control and surveillance of cosmetic products referred to in article 3 of Decision 516, as well as the establishments in charge of their production or marketing.
Likewise, this Regulation regulates the prevention, control, and sanction measures necessary for such purposes.

 b) LIABILITY

Notwithstanding the joint and several liabilities established in article 24 of Decision 516, both the holder of the Mandatory Health Notification and the manufacturer of the product are responsible for compliance with this Regulation, as well as supplying, at the request of the Competent National Authority, the information necessary to carry out the verification of sanitary quality.

OF THE SANITARY CONTROL AND SURVEILLANCE ACTIONS:

The Competent National Authority of each Member Country will carry out an annual program of periodic inspection visits, in order to verify that the cosmetic products manufactured or marketed comply with the technical specifications of the Mandatory Sanitary Notification.

Said risk map will consist of the classification of the products according to the possible health risk according to their nature, the background of the manufacturing or marketing companies, the type of product, and the type of process, among other criteria.

In order to guarantee compliance with its sanitary inspection and control functions, the Competent National Authority may inspect the establishments destined to elaborate, store, distribute, and commercialize cosmetics. For this purpose, the procedures established by the respective national laws must be complied with.

The Competent National Authorities may take samples at any of the stages of manufacture, processing, packaging, sale, transportation, or marketing of the products. For the purposes of inspection and sanitary control, the action and periodicity of the sampling will be determined by the random selection through the risk map.

Of all product sampling, the Competent National Authority will draw up a certificate signed by it and the person responsible for manufacturing or marketing, legal representative or person in charge of the establishment, stating the sampling method and the number of samples taken, leaving a copy of the certificate with a counter-sample or withholding sample.

 d) HEALTH SAFETY MEASURES
